These Terms and Conditions ("Terms") govern the use of services provided by Viveros Remodeling ("we," "our," or "the Company"), located in Oceanside, California, and apply to all customers contracting our services in Oceanside and surrounding areas.

By contracting our services, you ("Client") fully accept these Terms and Conditions.

1. Services Offered

Viveros Remodeling offers interior and exterior remodeling services, including but not limited to:

  • Complete Remodeling
  • Kitchen Remodeling
  • Bathroom Remodeling
  • Flooring and Tiling
  • Plumbing Services
  • Electrical Services
  • Painting and Finishes
  • Drywall Services

2. Quotes and Estimates

  • Initial Quote: We provide free estimates based on information provided by the Client.
  • Quote Validity: Estimates are valid for a period of 30 days from the date of issuance.
  • Changes in Scope: Any changes in the scope of work may result in a modification of the initial estimate.

3. Contracts and Agreements

  • Written Agreement: A detailed contract outlining the scope of work, costs, schedule, and other relevant terms will be required before commencing any project.
  • Applicable Laws: The contract will be governed by the laws of the State of California.

4. Payments and Billing

  • Initial Deposit: A deposit of [percentage]% of the total cost will be required before work begins.
  • Partial Payments: Payments will be made according to the schedule agreed upon in the contract.
  • Final Payment: The remaining balance must be paid upon project completion and after Client acceptance.

  • Obtaining Permits: Viveros Remodeling will handle obtaining all necessary permits for the project unless otherwise agreed.
  • Regulatory Compliance: All work will be performed in accordance with applicable local, state, and federal building codes and regulations.

6. Warranties

  • Liability Cap: Our total liability will not exceed the total amount paid by the Client for the services rendered.

9. Insurance

  • Coverage: We maintain liability and workers' compensation insurance as required by California law.
  • Certificates: Insurance certificates will be provided upon the Client's request.

10. Cancellations and Refunds

  • Client Cancellation: Cancellations must be notified in writing. Cancellation fees may apply as stipulated in the contract.
  • Company Cancellation: We reserve the right to cancel the contract in the event of the Client's breach, refunding any unused payments minus costs incurred up to that date.

11. Force Majeure

  • Disclaimer: We will not be liable for delays or failures due to causes beyond our reasonable control, including but not limited to natural disasters, governmental actions, or adverse weather conditions.

12. Dispute Resolution

  • Friendly Negotiation: In the event of disputes, both parties agree to attempt to resolve the matter amicably.
  • Mediation and Arbitration: If resolution is not achieved, the parties may opt for mediation or arbitration in accordance with California laws.

13. Confidentiality

  • Information Protection: All information shared between the Client and the Company will be treated confidentially and will not be disclosed to third parties without consent.

14. Data Protection

  • Legal Compliance: We comply with all applicable laws and regulations regarding personal data protection.
  • Use of Information: Client information will only be used for purposes related to the services provided.

15. Modifications to the Terms

  • Right to Modify: Viveros Remodeling reserves the right to modify these Terms and Conditions at any time.
  • Notification: Modifications will be effective upon posting on our website or notifying the Client.

16. Acceptance of Terms

  • Consent: By contracting our services, the Client acknowledges that they have read, understood, and accepted these Terms and Conditions.
